These Terms of Use govern your use of marcelinoviereck.com (the "Site") and the communications programs described below. By using the Site or opting in to communications, you agree to these Terms and to the Privacy Policy. If you don't agree, please don't use the Site.

Who I am

The Site is operated by Marcelino S. Viereck, a real estate salesperson licensed in Massachusetts and affiliated with Coldwell Banker Realty, 136 Dwight Road, Longmeadow, MA 01106. Massachusetts license #9567154. The Site provides information about real estate services, property listings, market conditions, and home values in Massachusetts.

No agency relationship

Using the Site, submitting a form, or receiving messages from me does not create an agency, fiduciary, or client relationship. That relationship begins only through a signed written agreement. Massachusetts law requires me to provide the Massachusetts Mandatory Licensee-Consumer Relationship Disclosure at our first personal meeting to discuss a specific property.

Information on the Site

Listing information is provided by MLS Property Information Network, Inc. (MLS PIN) and other sources. It is deemed reliable but not guaranteed and should be independently verified. Listings may be sold, withdrawn, or changed without notice.

Automated home-value estimates are not appraisals or comparative market analyses. Only a comparative market analysis and an in-person walkthrough can determine your home's market value. Content on the Site is general information, not legal, tax, mortgage, or financial advice. Consult the appropriate professional for those matters.

SMS Program Terms

  1. Program. By checking the SMS consent box on a form on this Site and providing your mobile number, you agree to receive recurring text messages from Marcelino Viereck, Coldwell Banker Realty, about your real estate inquiry, including property information, appointment scheduling and reminders, market updates, and follow-up on services you requested.

  2. Consent is not required. Consent to receive texts is not a condition of any purchase or of receiving real estate services.

  3. Message frequency varies.

  4. Message and data rates may apply. Check your wireless plan for details.

  5. Opt out. Reply STOP to any message to stop receiving texts. You'll receive one confirmation message, and no further messages will be sent unless you opt in again. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT.

  7. Carriers. Wireless carriers are not liable for delayed or undelivered messages.

  8. Eligibility. You must be 18 or older and the account holder or authorized user of the mobile number you provide.

  9. Privacy. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy.

Email and phone communications

If you provide your email address or phone number, you agree that I may contact you about your inquiry and related real estate services. Every marketing email includes an unsubscribe link. I honor the National Do Not Call Registry and internal do-not-call requests.

Acceptable use

Site content, including text, graphics, logos, and photographs, is owned by me or my licensors and protected by copyright and trademark law. You may view and print it for personal, non-commercial use only. Coldwell Banker and the Coldwell Banker logo are registered trademarks used under license.

Third-party sites and tools

The Site may link to or embed third-party websites and tools. I don't control them and am not responsible for their content, accuracy, or practices.

Disclaimer and limitation of liability

The Site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, I am not liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on its content.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute will be handled in the state or federal courts located in Massachusetts.

Changes to these Terms

I may update these Terms from time to time. The effective date at the top shows the latest version. Continued use of the Site means you accept the updated Terms.
